IMPORTANT: VibeSafe is an automated scanning tool that provides informational guidance only. It is NOT a substitute for professional security audits, penetration testing, or expert consultation.

1. Acceptance of Terms

By accessing or using VibeSafe ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

VibeSafe is an automated security scanning tool that analyzes publicly accessible websites for common security issues. The Service uses automated tools and AI to identify potential vulnerabilities and provide general guidance.

3. Limitations of Service

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

  • Not Comprehensive: VibeSafe performs automated scans that check for common security issues only. It does NOT perform comprehensive security audits, penetration testing, code reviews, or infrastructure assessments.
  • No Guarantee: VibeSafe does NOT guarantee detection of all vulnerabilities. New vulnerabilities are discovered daily, and automated tools cannot detect all security issues.
  • Not Professional Advice: Reports generated by VibeSafe are for informational purposes only and do NOT constitute professional security advice, legal advice, or certification of any kind.
  • AI Limitations: Our analysis uses artificial intelligence which may produce false positives (reporting issues that don't exist) or false negatives (missing real issues).
  • Point-in-Time: Scans represent the state of your website at the time of scanning. Security posture can change immediately after a scan.

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF RESULTS
  • THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • VibeSafe, its owners, operators, employees, and affiliates shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
    • Your use of or inability to use the Service
    • Any security breaches, hacks, or unauthorized access to your systems
    • Any vulnerabilities not detected by the Service
    • Any actions taken or not taken based on scan results
    • Any loss of data, revenue, profits, or business opportunities
  • Our total liability for any claims shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless VibeSafe and its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any security incidents affecting your systems

7. Professional Security Recommendation

We strongly recommend that you engage qualified cybersecurity professionals for comprehensive security assessments, especially if you:

  • Handle sensitive user data (PII, financial, health information)
  • Process payments or financial transactions
  • Are subject to compliance requirements (HIPAA, PCI-DSS, GDPR, SOC 2)
  • Operate critical infrastructure or services
  • Have experienced a security incident

8. Subscription, Cancellation, and Refund Policy

Subscription Terms:

  • Paid subscriptions are billed monthly in advance.
  • Your subscription renews automatically each billing cycle until cancelled.

Cancellation:

  • You may cancel your subscription at any time from your account settings.
  • Upon cancellation, you retain access to paid features until the end of your current 30-day billing period.
  • After the billing period ends, your account reverts to the Free plan.

No Refunds:

  • All payments are final and non-refundable.
  • We do not provide refunds or credits for partial subscription periods, unused scans, or plan downgrades.
  • By subscribing, you acknowledge and agree to this no-refund policy.

9. Acceptable Use

You agree to:

  • Only scan websites you own or have explicit authorization to test
  • Not use the Service to facilitate attacks on any system
  • Not attempt to circumvent rate limits or access controls
  • Not resell or redistribute scan results without permission

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We do not store the content of scanned websites beyond what is necessary to generate reports.

11. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
